Town offices, the 2023 Comprehensive Plan Update and Erie County tax and health rules, as the Town of Sardinia and Erie County post them, read in October 2026. General information, not legal or tax advice.

No public sewer anywhere in Sardinia, so every sale gets a septic inspection

The Town’s 2023 Comprehensive Plan Update is blunt about it: there is no public sewer infrastructure in Sardinia, and every home and business relies on its own on-site system. Water is almost as local. A private community water system serves about 200 residents in Chaffee; outside that hamlet, most houses draw from a private well.

For a seller, that means one step is close to certain. The Erie County Sanitary Code (Article IV, Section 12) bars a title transfer on a house with septic or a private well until the County Health Department has issued a Property Transfer Certification. Around the time you plan to sell, you send the application and fee:

  • $300 for a house on septic with public water.
  • $496 for septic and a private well together. The well gets a bacteria test and a look at its casing and location.
  • What the visit involves: a dye test of the septic, usually spread over three days, with someone 18 or older at the house. You’ll be asked to run a set amount of water, typically 100 gallons per bedroom per day. Clear tall grass and brush off the system area first, and leave the tank unpumped.

Timing is the catch in Sardinia’s winters. Snow cover or frozen ground halts the dye tests, and a house that’s been vacant over 90 days won’t get the standard inspection at all. Either way, the closing goes ahead only with a Variance of Property Transfer Certification. The Health Department’s number is (716) 961-6800; call it as soon as you’re thinking about selling. We buy Sardinia houses as-is, and the County rule still applies when the buyer is us.

If you’re not sure whether Chaffee’s community system counts as public water for the fee, ask the Health Department when you apply.

A Sardinia tax bill with no town tax on it

The Comprehensive Plan says plainly that there are no Town taxes in Sardinia, and Erie County’s 2025–2026 tax comparison shows the Town’s tax rate as zero. On the County’s example bill, the lines that remain are county and school taxes. The plan also notes that the Waste Management landfill in Chaffee provides revenue to the Town.

Which school district you’re in sets most of the bill. The Town lists three: Springville-Griffith Institute, Holland and Pioneer. The County’s example is a house with a $150,000 market value, assessed at $49,500 under Sardinia’s 33% equalization rate. With a Basic STAR exemption, the total comes to about:

  • Springville-Griffith Institute: $1,905
  • Holland: $1,573
  • Pioneer: $1,491

For a rough idea of market value from your own assessment, divide by 0.33. An assessment of $70,000 is about $212,000 of value. That’s the County’s rate doing the math, not an appraisal.

No town tax doesn’t mean no back taxes: county and school bills can still go unpaid. Before you sell, ask the Town Clerk and Tax Collector what’s open on the parcel.

Chaffee, Sardinia and Protection

The Town of Sardinia covers just over 50 square miles in the southeast corner of Erie County. It was settled in 1809 and split off from the Town of Concord in 1821. Holland and Colden are to the north, Concord to the west, and the Town of Arcade in Wyoming County to the east. Cattaraugus Creek is the south line, and across it are Yorkshire and Ashford in Cattaraugus County.

The Town says it has three small population centers: the hamlets of Sardinia, Protection and Chaffee. Chaffee began as “Sardinia Junction,” where the Springville and Sardinia Railroad met the Pennsylvania line, and it was renamed for the railroad’s president, Bertrand Chaffee; its post office opened in 1881. Today the plan places most of the town’s businesses along Route 16, with commercial uses clustered around Chaffee and the hamlet of Sardinia.

Chaffee is also home to a landfill. The plan says about 240 acres of a 500-acre site are in active use, that it has been a landfill from 1958 on, and that Waste Management of New York runs it under state DEC permits and a Town special use permit, with an expansion approved in 2023.

Farms cover much of the rest. More than half the town’s land is actively farmed, according to the plan, and Sardinia’s agricultural district became part of Erie County’s Consolidated Southeast Agricultural District No. 15 in 2017. A house partly or wholly inside an agricultural district comes with a disclosure notice under Agriculture and Markets Law §310: the seller gives it to the buyer when the purchase contract is presented, warning that nearby farming can bring noise, dust and odors.

Sardinia Town Hall on Savage Road

Town offices are at Town Hall, 12320 Savage Road, Sardinia, main number (716) 496-8900.

  • Town Clerk and Tax Collector: extension 10. Open Monday through Thursday 9 to 4, and Friday 9 to noon.
  • Assessor: extension 12. Thursdays from 11 to 2, other times by appointment. The 2026 final roll is posted on the Town’s site.
  • Code Enforcement Officer and building inspector: extension 19, by appointment.
  • Highway Department: the highway garage, (716) 496-7526.

Floodplains are narrow here. The plan says the town’s 100-year floodplain runs along Cattaraugus Creek and hugs the other stream corridors, and that FEMA’s latest update didn’t change the boundaries much. If your land runs down to the creek, check the FEMA map before you price it.

Renting it out, or selling with a tenant

Most Sardinia houses are owner-occupied, about 83% by the plan’s count, but roughly one in six is rented. For anything court-related, the Town says to call Sardinia Town Court at (716) 496-8903. The court’s page doesn’t describe evictions. In the neighboring Town of Concord, the court says its eviction filings are transferred to the Erie County Landlord Tenant HUB Court, so ask the Sardinia clerk where a case would be heard before you file.

State law sets the notice. If you plan to end a lease at renewal or raise the rent 5% or more, Real Property Law §226-c requires written notice to the tenant, from 30 to 90 days depending on how long they’ve rented. Sardinia isn’t a Good Cause Eviction locality; the state’s May 2026 list had no Erie County town on it.

You don’t need an empty house to sell. We buy rented Sardinia houses and can help with the tenant side depending on the situation. See selling a rental property with tenants.

Sardinia houses

Sardinia’s houses are mostly single-family, and many are old. The Comprehensive Plan, using 2017–2021 Census survey data, counts about 93% single-family homes, 3% doubles, 2% small apartment buildings and 2% mobile homes. About 31% were built before 1940. Building peaked in the 1970s, and the plan says only 22 homes went up in the last 15 years, with no subdivision of five or more lots from 2003 on. Most houses sit on large rural lots along the main roads, partly because septic systems need the room.

Estates, foreclosure, back taxes and title problems in Sardinia

A parent’s house in an estate

An empty farmhouse can run into the Health Department’s 90-day vacancy rule, so ask about a variance early. See selling an inherited house in Buffalo and Erie County.

Behind on the mortgage

Mortgage foreclosures on Sardinia houses go through Erie County Supreme Court in Buffalo, not anywhere in Sardinia. See how to stop a foreclosure.

Behind on property taxes

With no town tax, the open balances are county and school taxes. See selling a house with back taxes.

How a sale to us works in Sardinia

  1. 1. Tell us about the house

Which hamlet or road, whether it’s on Chaffee’s water or a well, and what’s going on: an estate, a tenant, acreage, old taxes.

  2. 2. Hear our offer

Cash offer within 24 hours, usually by phone.

  3. 3. Leave the contents

No repairs and no open houses. Take what you want and leave the rest. We cover the standard closing costs.

Most closings take 14–30 days, or on your timeline. Close in as little as 5 days. Title problems? We can close in as little as 48–72 hours, because we don’t wait on title insurance.

When listing a Sardinia house makes more sense

A Sardinia house in good shape, with a septic system that will pass and no deadline hanging over it, will usually sell for more through an agent than to us, and if that’s yours we’ll tell you on the first call. We fit better when the farmhouse needs real work, when the septic or well is in doubt, when an estate is settling the house from out of town, or when there’s a tenant. Some houses we won’t buy, and we’ll be clear about that right away.

Sardinia sellers ask us

Is there really no town tax in Sardinia?

That’s what the Town’s Comprehensive Plan says, and Erie County’s 2025–2026 comparison shows a town tax rate of zero. You still owe county and school taxes.

The house is on septic and nobody’s lived there since spring. What now?

If it has been empty more than 90 days, the Health Department won’t do its standard property transfer inspection, and the sale needs a variance. Call (716) 961-6800 to ask what they’ll need.

My address says Chaffee. Is that a different town?

No. Chaffee is one of three hamlets in the Town of Sardinia, along with Sardinia and Protection. Your town offices are on Savage Road.

I live out of state. Can I still sell my Sardinia house?

Yes. We usually make the offer by phone.
